By using LCS Products, Inc. web sites (lcsproducts.com, chaircaps.com, chaircap.com, floorsaverglides.com) you hereby agree to be bound by all of the terms and conditions contained in this User Agreement (“Agreement”). LCS Products, Inc. reserves the right to change these Terms at any time, effective immediately upon posting on the Site.
All information displayed, transmitted or carried on LCS Products, Inc. web sites (including, but not limited to, reviews, text, photographs, images, illustrations, audio clips, video clips, trademarks, service marks and the like, collectively the “Content”) is protected by copyright and other intellectual property laws. The content is owned by LCS Products, Inc., its affiliates or third party licensors. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display, or in any way commercially exploit any of the content or infringe upon trademarks or service marks contained in such content. You agree to abide by all copyright notices and restrictions attached to any content accessed through the LCS Products, Inc. web sites, not to alter the content in any way, and not to alter or remove any trademark, copyright or any other notice from copies of the content.
You may make a single copy of the content displayed on the LCS Products, Inc. web sites for personal, noncommercial use only, provided that you do not remove any trademarks, copyright and any other notice contained in such Content. You shall not archive or retain any content in any form without the written permission from LCS Products, Inc. You may not distribute (including via e-mail or the Internet), or otherwise make available, copies to others, whether or not for payment or other consideration, without the written permission from LCS Products, Inc. You agree that you are only authorized to visit, view, and retain a copy of pages of LCS Products, Inc. web sites for your own personal use, and that you shall not duplicate, download, publish, modify, or otherwise distribute the material on any LCS Products, Inc. web sites for any commercial use, or for any purpose other than as described in these Terms.
LCS Products, Inc. may modify, suspend, discontinue or restrict the use of any portion of the LCS Products, Inc. web sites, including the availability of any Content feature, at any time and without notice or liability.
All orders placed on any of our websites will be shipped Freight On Board (FOB): ORIGIN.
A customer can also arrange and pay for all shipping directly with any shipper of their choice. Please email our shipping department after your order is placed at support@chaircaps.com. This department will arrange for a refund of the shipping cost placed on our website, and assist in your shipping needs. A copy of the shipping documents may be necessary for our records prior to your items being shipped.
All domestic orders shipped by FedEx come with tracking and insurance included for up to $100 per package. United States Postal Service (USPS) is insured for up to $100 per package if shipped via Ground Advantage or Priority Mail for domestic shipments only. If you would like to add additional insurance, please contact our office for a quote on higher-value insurance for your package(s). Tracking is provided for ALL shipments.
LCS Products chooses which carrier will deliver your shipment, and some of our shipments require a signature. The carrier may also require a signature at their discretion. The carrier may make subsequent delivery attempts before returning the shipment to LCS Products. If you are unavailable to provide a signature, LCS Products offers an easy option for you to receive your package.
After the first delivery attempt, you can request to pick up your package at our carrier's local facility. Call the number on the carrier's Delivery Notice and inform them you'd like to pick up your package in person. To pick up your package from the carrier's local facility, you may need: the Delivery Notice; Government ID (driver's license, passport) that matches the package name and address; and a second ID with your name on it (credit card, social security card). The carrier can release the package only to the person included on the shipping address.
Signature Confirmation is available at NO CHARGE for all customers. Please request this service after you place your order via email at support@chaircaps.com or via fax at 561-776-1836. If you do NOT request Signature Confirmation, you have agreed that the USPS or FedEx delivery confirmation notice will serve as a Signature Confirmation. You agree that Confirmation of Delivery via USPS or UPS is the SAME as Signature Confirmation and agree that the merchandise has been delivered, as if you had signed for the delivery in-person.
LCS Products, Inc. does ship internationally with a few exceptions. Please note that you, the buyer, are responsible for any VAT, tariff, duty, taxes, handling fees, customs clearance charges, etc. required by your country for importing consumer goods. We do not collect this beforehand, and can't give you an estimate of the cost, because it varies widely around the world. Please do your research so you're ready to get your package cleared through customs, and know what the additional cost will be.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms, your use of any LCS Products, Inc. website, or any products or services offered through them (a “Dispute”) will be resolved by binding arbitration rather than in court, except that either party may bring an individual claim in small claims court instead of arbitration if it qualifies.
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, including any AAA rules addressing multiple, similarly-situated claims. Information about the AAA and its rules is available at www.adr.org. The arbitrator, and not any court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of it is void or voidable.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to LCS Products, Inc., 3330 Fairchild Gardens Ave., Suite 31928, Palm Beach Gardens, FL 33410, or by emailing support@chaircaps.com, stating your name and a clear statement that you wish to opt out of arbitration. If you opt out, only the arbitration agreement will not apply to you — the rest of these Terms still applies.
You and LCS Products, Inc. each agree that any Dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If a court or arbitrator determines that this class action waiver is unenforceable as to a particular claim or request for relief, that claim or request must be brought in court, and all other claims remain subject to arbitration.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. For any Dispute not subject to arbitration (such as an individual action in small claims court, or a claim excluded above), you agree to the exclusive jurisdiction of the state and federal courts located in Palm Beach County, Florida.
